La defensa del dueño de la finca en la que se encuentra el pozo en el que murió Julen, el niño de dos años que cayó en enero de este año en dicha perforación, estudian solicitar la nulidad de la instrucción por graves deficiencias que habrían seriamente comprometido el derecho de defensa de su cliente, único acusado en esta causa. Así lo han informado desde la defensa de David Serrano, indicando que el planteamiento de la supuesta nulidad se basa en el análisis de hechos concretos de una instrucción que, a juicio de los letrados, se habría diseñado a la medida de los padres de Julen para evitarles el trance de una posible imputación, tanto por Fiscalía como por el propio Juzgado. Los letrados han apuntado que se da la circunstancia de que la titular del Juzgado ya había instruido unas diligencias anteriores contra el padre, José Roselló, donde este resultaba condenado.
